Health and Safety Code 11834.026 still defines incidental medical services. Other than those services, a licensed alcoholism or drug abuse recovery or treatment facility shall not provide medical services. Incidental medical services as defined in 11834.026 shall be specified on the face of the license.

Members under age 21 qualify to receive all medically necessary DMC-ODS services as required pursuant to Section 1396d(r) of Title 42 of the United States Code. Access criteria for members under 21 are different and more flexible than the access criteria for adults accessing DMC-ODS services, to meet the EPSDT mandate.

BHIN 24-001 says access to medically necessary services cannot be denied for members meeting criteria for DMC-ODS services nor shall members be put on wait lists. If the DMC-ODS network is unable to provide medically necessary covered services, the DMC-ODS plan must adequately and timely cover these services out-of-network for as long as the network is unable to provide them.
