11834.09 city notice on a new license

Health and Safety Code 11834.09 lets the department issue a single license to operate an alcohol or other drug recovery or treatment facility upon receipt of a completed written application, fire clearance, and licensing fee, subject to the department's review and determination that the applicant can comply with the chapter and its regulations. Whenever the department issues that license, it shall concurrently provide written notification of the issuance to the city in which the facility is located. If the facility is located within an unincorporated area, the notice shall instead be provided to the county. The notice shall include the name and mailing address of the licensee and the location of the facility. Failure to submit a completed written application, fire clearance, and payment of the required licensing fee in a timely manner shall result in termination of the department's licensure review and shall require submission of a new application. Initial licenses for new facilities shall be provisional for one year. During the term of the provisional license, the department may revoke the license for good cause, meaning failure to operate in compliance with the chapter or the regulations. A licensee may not reapply for an initial license for five years following a revocation of a provisional license.

Of that total served count in SFY 2022-2023, Outpatient Drug-Free was 30.1 percent. Narcotic Treatment Program was 35.8 percent. Residential (Short/Long Term) was 19.2 percent. Residential Detoxification was 7.4 percent. Intensive Outpatient Treatment was 7.2 percent. NTP Detoxification was 0.2 percent. Non-NTP Detoxification was 0.0 percent. ODF, NTP, and NTP Detoxification decreased from the prior year. Residential (Short/Long Term) and Residential Detoxification increased.

11834.03 license application fee

Health and Safety Code 11834.03 says a person or entity applying for licensure shall file a completed written application for licensure, a fire clearance approved by the State Fire Marshal or local fire enforcement officer, and a licensure fee established in accordance with Chapter 7.3 commencing with Section 11833.01. If an applicant intends to permit incidental medical services pursuant to 11834.026, the applicant shall submit evidence of a valid license of the physician and surgeon who will provide or oversee those services. The department shall establish and collect an additional licensure fee for an application that includes a request to provide those services, set at an amount sufficient to cover the reasonable costs of the additional assessment and investigation, including processing applications, issuing licenses, and investigating reports of noncompliance.

DMC-ODS 40-county SNAP door

The 2025 SNAP report writes that as of January 2025 there are 40 counties that have opted into the DMC-ODS Program, representing 96.92 percent of California's Medi-Cal population. DHCS created the capacity management and waiting list program, Drug Alcohol Treatment Access Report (DATAR), for counties to report when they reach 90 percent of their capacity to admit individuals into treatment. BHIN 24-001 says access to medically necessary services, including all FDA-approved medications for OUD, cannot be denied for members meeting criteria for DMC-ODS services nor shall members be put on wait lists. BHIN 24-001 short-term resident

BHIN 24-001 writes that a client receiving Residential or Inpatient Services pursuant to DMC-ODS, regardless of the length of stay, is a short-term resident of the residential or inpatient facility in which they are receiving the services. Each member shall live on the premises and shall be supported in their efforts to restore, maintain, and apply interpersonal and independent living skills and access community support systems. Residential and Inpatient Treatment Services require a clearly established site for services and in-person contact with a beneficiary to be claimed.

11834.17 fire rules and civil penalties

Health and Safety Code 11834.17 says a city, county, city and county, or district shall not adopt or enforce a building ordinance or local rule or regulations relating to the subject of fire and life safety in alcohol or other drug recovery facilities that is more restrictive than those standards adopted by the State Fire Marshal. Health and Safety Code 11834.15 says the department may assess civil penalties in accordance with Sections 11834.31 and 11834.34. Health and Safety Code 11834.34 says the amount of the civil penalty, as determined by the department, shall not be less than two hundred fifty dollars ($250) or more than five hundred dollars ($500) per day for each violation, except where the nature or seriousness of the violation or the frequency of the violation warrants a higher penalty or an immediate civil penalty assessment, or both, as determined by the department. In no event shall a civil penalty assessment exceed one thousand dollars ($1,000) per day. Prior to the assessment of any civil penalty, the department shall provide the licensee with notice requiring the licensee to correct the deficiency within the period of time specified in the notice.
